Some debtors will fail to pay notwithstanding the DCA process. This will ultimately result in higher costs to the debtor under the legal process. In some cases, it may be worthwhile to pursue payment via legal recovery. The process also signals to other potential bad debtors that there is a willingness to pursue payment via all available avenues.
Legal Debt Recovery Process
The objective of the Legal Debt Recovery process is to secure payment whenever possible without the need to issue legal proceedings. In many cases, the initial demand secures positive engagement and obviates litigation and further legal costs for the debtor. Service features include:
- Legal advice prior to and during recovery
- Instructions sought from the client prior to each step
- Management of payment plans
- Collection and remittance of funds
- Management of court proceedings where required
- Securing and enforcing judgement as required
- Regular reports on the status of each case in hand
- Assignment of an experienced in-house solicitor
- Assignment of an Account Manager
- Provision of contact escalation paths
- Full compliance, including with GDPR.
